Streszczenie:

The main purpose of the article is to determine the mutual relations between mediation and court proceedings, as well as to answer the question whether mediation services provided by out-of-court entities should be considered as a part of the justice system and fulfill the constitutional right to court. The conducted research leads to the conclusion that both the judiciary and mediation should be considered as complementary methods of dispute resolution, although the first of them is granted primacy under the Polish Constitution i.a. due to the fact that mediation settlements are subject to court approval and not all types of disputes can be resolved bindingly in mediation. Mediation does not belong sensu sticto to the definition of the judiciary and does not fulfill the right to justice but may be included in a broad understanding of the judiciary and therefore its existence according to current regulations does not violate the position and rules of functioning of the judicial system. However, this situation can easily change, if the mandatory mediation planned by the legislator in divorce and legal separation cases comes into force.

Streszczenie:

The paper deals with the issues related to the right to education under the Constitution of the Republic of Poland of 1997 and to the actual operation of the education system. The main focus is on the constitutional guarantee of equal access to education. This guarantee should be treated as Kant’s Regulatory Idea which should be pursued by public authority though its full attainment is not possible in social reality. This study attempts to indicate to what extent the state’s obligation to ensure equal access to education is implemented by the institution of the school in Poland.

The paper considers issues regarding the right to health protection on the basis of the Constitution of the Republic of Poland of 1997 and the actual performance of the health protection system for the elderly. Particular attention is devoted to the constitutional guarantee of equal access to medical services. The purpose of this study is to check to what extent public guarantees of access to medical services are in conflict with the reality of the health protection system for the elderly.

Streszczenie:

The paper aims at analyzing the phenomenon of judicial activism in Poland against the background of a resolution of the formation of the combined Civil Chamber, Criminal Chamber and Labor Law and Social Security Chamber of the Supreme Court of 23 January 2020 (BSA I-4110-1/20). The author discusses the Supreme Court’s powers to resolve divergences in the interpretation of law and then provides an analysis of the nature of the resolution of the Supreme Court. The considerations made in the context of the paper lead to the conclusion that in situations of a threat to the rule of law the courts not only have a right but also an obligation to take active measures to protect the common good.

autonomy to select The objective of this study is to analyze the process of implementing European Union law into the legal system of the Republic of Poland. EU law is to be incorporated in the Polish legl system in such a way as to safeguard its binding force. In other words, it is necessary to ensure the effectivness of European Union law in the legal system  of the Republic of Poland. The Member States are obliged to implement European Union law.This obligation arises out of the adoption of the treaties establishing the European Union, but it s also rooted in the Constitution. It is worth noting that a Member State has the autonomy to selectthe method of incorporating European Union law in its legal system. In the case of the Republic of Poland, the process of implementing European Union law is linked particularly closely to the adoption of statues implementing the provisions of European Union law into the legal system of the Republic of Poland. Should Poland fail to implement EU laws in its legal system properly, it may incur financial liability to the European Union, as well as its own citizens.

Streszczenie:

The purpose of the article is to draw attention to the jurisprudence of the Constitutional Tribunal in the context of the issue related to the same principles of access to public service, which are guaranteed by the Art. 60 of the Polish Constitution.The analysis of the Court’s judgments makes it possible to relate the interpretation of this provision to the principle of proportionality and equality before the law. Both in the jurisprudence of the Tribunal and the Supreme Court, attention is paid to the transparency and openness of the rules used to determine the requirements related to taking up public office functions.

Streszczenie:

Experiences related to the global financial crisis of 2008 and to subsequent turbulence in the financial market, and also to threats connected with the COVID-19 pandemic, demonstrate the evolution of the aims of the functioning of central banks. The goal of monetary stability, which means attempting to ensure low inflation, has proved insufficient. As a part of building a new architecture of financial regulation and supervision (at international, European, and national level), the mandate of central banks has been strengthened and supplemented with activities aimed at ensuring the stability of the financial system, understood as a state of affairs in which systemic risk does not accumulate. The aim of this article is to analyze the systemic role of the NBP (Polish Central Bank) from the point of view of the contemporary evolution of the role of central banks within the financial safety net.

Partnership and social dialogue are fundamental values for relations between administrative entities, because due to the nature and importance of these, they have been coded by the rational legislator in the principles of law expressed in the Constitution. Due to the relationship between administrative law and its principles and constitutional law, the postulate of including social partners in the decision-making processes of the executive authority can be observed, which is exemplified by the functioning of entities implementing joint actions in the scope of administrative programming acts.

Streszczenie:

What proves to be characteristic of the democratic system is the fact that it constantly witnesses various tensions between authorities, opposition, citizens, diverse legal subjects, advocacy groups, etc. Their disputes concern changing or upholding the existing legal environment, which is unavoidable in this case. This situation is not surprising or improper as lobbying understood in this way is an immanent, often useful part of the system. However, what may be puzzling is the fact that democratic political systems are characterized by the variety of attitudes adopted by authorities toward the practice - from pretending it does not exist (and thus requires no regulations) to implementing regulations of a highly general nature. Poland experiences both the practice itself and the attempts to legally regulate it. The aim of the article is to critically analyze the existing situation.

Streszczenie:

The article presents the issue of compliance of the Polish Constitution with the Act of 11 September 2015 on the entitlement to the property of the Holiday Employee Fund (Dz.U. No. 1824). The author presents the origins of the organization, and what changes have taken place in its legal status. The Act regulating the status of assets after Holiday Employee Fund was declared unconstitutional in 1997. The legislator had to regulate this issue again, which did not happen until 2015. The author estimates the new regulation based on the constitutional principles of protection of property rights, democratic rule of law, non-retroactivity and certainty of real estate transactions.
