The electoral system of Bosnia and Herzegovina, introduced in November 1995, from the very beginning was believed by a number of experts to be incompatible with democratic standards. However, for many years no one dared to challenge it, fearing a breach of peace. Only a protest filed with the European Court of Human Rights by the members of the Roma and the Jewish minorities caused that laws protecting only the Bosnians, Serbs and Croats are contrary to the generally applicable solutions in Europe, including the law theoretically applicable also in Bosnia and Herzegovina. The court ruling released in December 2009 could be the beginning of rebuilding undemocratic practices in this deeply divided country.
