General Council of the Judicial Power of Spain – Composition, Appointment, Crises

The constitutional regulation of the composition and appointment of the Spanish Consejo General del Poder Judicial is laconic. The Constitution stipulates that the Council consists of the President of the Supreme Tribunal (also the President of the Council), and twenty members appointed by the King. Twelve of them are the judges in apppointed in accordance with the organic law, four at the request of the Congress and four at the request of the Senate, by a majority of three-fifths of the deputies of each chamber, from among lawyers of recognized competence and more than fifteen years of practice. The organic law transferred the election of judicial members of the Council to the competence of the chambers of the Cortes, which caused crises. The last one lasted 6 years and paralyzed the work of the Council. This calls into question the correctness and reasonableness of the Spanish solutions.

Regulacja konstytucyjna składu i powoływania członków hiszpańskiej Consejo General del Poder Judicial jest krótka i lakoniczna. Konstytucja przewiduje, że Rada składa się z Prezesa Trybunału Najwyższego, który jej przewodniczy, oraz z dwudziestu członków powoływanych przez króla na okres 5 lat. Dwunastu z nich król powołuje spośród sędziów na zasadach ustalonych przez ustawę organiczną, czterech na wniosek Kongresu Deputowanych i wreszcie czterech na wniosek Senatu, większością trzech piątych deputowanych do każdej z izb, spośród adwokatów i innych prawników o uznanej kompetencji i ponad piętnastoletniej praktyce w zawodzie. Ustawa organiczna wybór sędziowskich członków Rady przekazała do kompetencji izb Kortezów, co wywołuje liczne kryzysy. Ostatni z nich trwał aż 6 lat i sparaliżował prace Rady. Stawia to pod znakiem zapytania prawidłowość i sensowność rozwiązań hiszpańskich.
