Threat to Human Rights Derogation in the Context of Polish Counter-Terrorism Legislation

Terrorist attacks are presently one of the most serious threats to human life and security, both for states and individuals. The protection of these assets is one of the most important obligations of the state. Increasingly, this comes at the expense of other goods, such as the protection of freedoms and human rights. This article reflects on the threat of human rights derogation in the context of counter-terrorism regulations currently in force in Poland. International treaties safeguarding the protection of fundamental freedoms and human rights, on a global and regional scale, contain clauses allowing their temporary derogation due to any danger threatening “the life of the nation”. According to these clauses, derogation may be used in emergency situations, when there is clear and present danger for society as a whole and for the functioning of democratic institutions. Terrorist events as defined in the Polish Counter-Terrorism Act, are not qualified as such. Derogation is permissible when certain conditions are met and for a limited period of time, both of which are not clearly defined in the relevant provisions of the Act. As a consequence, the content of a number of these provisions is arguably violating the guarantees prescribed in international treaties.

This paper examines employees’ rewards and job commitment to an organisation. Rewards are economic and non-economic gains one secure from a job. It’s basically concern with pay and employee benefits which determine how workers are committed to their job. Adequate rewards for employees often paved way for a high degree of job satisfaction as well as achieving the desired goals of the management in an organisation. This paper is anchored on the interpretative understanding of expectancy theory by Victor Vroom which has a better understanding of explaining the behavioural process of why an individual will decide to behave or act in a certain way. It is expected that the management of an organisation should pay much attention to the plight of employees on remuneration-related matters because their dissatisfaction could lead to non-performance and poor productivity in the workplace. However, the management or the managers needs to motivate, attracts, satisfy and retains their employees to achieve the highest guarantee for organisational success, productivity and performance for the organisation.

Nigerian society has long embedded traditional conflict resolution mechanisms, reflecting diverse cultural norms and values. However, the advent of modernity has introduced complexities that intersect with traditional practices, presenting both challenges and opportunities for conflict resolution. This study explored the evolving dynamics of traditional conflict resolution in Nigeria within the context of modernity. Through a comprehensive analysis of literature and expert insights, the study examines the challenges faced by traditional conflict resolution systems in adapting to the demands of contemporary society. These challenges include issues such as urbanisation, globalisation, legal pluralism, and technological advancements, which often strain the efficacy and relevance of traditional approaches. Despite these challenges, the research identifies significant opportunities inherent in navigating modernity within traditional conflict resolution frameworks. These opportunities encompass the adaptability of traditional practices to modern contexts, the preservation of cultural heritage, intergenerational knowledge transfer, and the potential for innovation through hybridization with modern approaches. By embracing these opportunities, traditional conflict resolution systems in Nigeria can not only address contemporary conflicts effectively but also contribute to the preservation of cultural identity and social cohesion. Through a nuanced exploration of challenges and opportunities, this study contributes to a deeper understanding of the intricate dynamics shaping traditional conflict resolution in Nigeria. By recognising and leveraging the potential synergies between tradition and modernity, stakeholders can foster more inclusive, resilient, and sustainable approaches to conflict resolution in the Nigerian context.
