The Law of the 13th of July, 1939 on Abolishing Fees Tail did not abolish itself that institution, represented then by 55 estates subject to different regulations in divers parts of the territory of the Republic of Poland, but it provided for an evolutive process of abolition, to be initiated by the patriarch or ex officio, and accomplished by the decision of the Appellate Court on abolition. Abolition meant that the patriarch, having been a “possessor” of the fee tail belonging to the whole family, was to become a regular owner of its goods. Because of the World War, II no fee tail was abolished within the framework of that Law. All existing fees tail were abolished ex lege, in the new post-war conditions marked, in particular, by realization of the land reform, by the 1946 Law-Decree providing for introductory provisions of the succession law. It repealed the 1939 Law, but maintained in force its substantive provisions defining the essence of fees tail. In the article, an analysis is developed of legal problems related to legislation on abolition of fees tail that arise out in the present Polish legal practice. It relates to the problem of the right of the 1939 fee tail patriarch to receive, on the basis of the 2005 particular law, a compensation for estates left on the pre-war territory of the Republic of Poland taken by the USSR; it could be given only to the then owners being physical persons, and not to simple holders. There have been two cases decided over by administrative courts, and their approach, and to a certain extent decisions, have been quite different. The other problem examined relates to the present right of ownership of library collections having belonged to two fees tail, and the respective rights of the National Library of Poland that keeps those collections.

The impulse for this paper was a controversial ruling of the Supreme Court of 10 January 201717, in which the Court refused to treat contractual work performed by a performer in an orchestra as a contract for specific work and stated that it was rather a contract for the provision of services. To justify that position, the Court found that: “The statement that the contract for a specific work was to consist in the staging and performance of a concert, makes it impossible to clearly ascertain the detailed parameters of the agreed outcome”. The Court further pointed out that: ”Adding to the fact that the interested party was one of the performers subordinated to the conductor, it is hard to conclude that the parties clearly defined the shape of the specific work in question. (...) On the contrary, this leads to a conclusion that the interested party and the remitter were bound by a contract for the provision of services”. However, the wording of the Supreme Court’s judgment should be considered erroneous as no basis therefor can be found in the knowledge and practice of performing music. Moreover, following the line of the Supreme Court’s reasoning, it turns out that a contract for specific work consisting in an artistic performance during a concert, can only be concluded if it involves creating a new piece, i.e. if it is improvised or spontaneously created. However, if a piece is not created anew and we are dealing with an artistic performance only, a contract for specified services should be concluded. And with that, one cannot agree.

Non-payment of child support has been penalized since Poland regained its independence, despite doubts sometimes raised. The changes in this respect in the subsequent penal codes of 1932, 1969 and 1997 were in fact not very significant. Changes in the Penal Code concerned the problem of persistence, the inability to meet the basic needs of life, the basis for fixing the maintenance obligation. Amendment of the existing Article 209 of the Penal Code, which lays down the liability for evasion of the maintenance obligation, must be regarded as unsuccessful.

The text examines standards of freedom of speech stipulated by the case-law of the European Court of Human Rights in Strasbourg. The focus is on political expression, which deserves the greatest scope of protection according to Western norms determined by the jurisprudence of the mentioned court and the Supreme Court of the United States. In this connection, the latter has significantly influenced the case-law of the former. The text under discussion analyses the problem from the perspective of the case of Ziembiński versus Poland (2), 2016.

Undoubtedly linking is one of the technologies that constitute a basis of the web. Links are most commonly used for indication of the place of content in the richness of the internet. However, they can also be used for illegal actions concerning communication of works protected under copyright. Legality of linking depends on the classification whether they are communicating such work to the public in the meaning of art. 3 (1) of Directive 2001/29/WE. Court of Justice of European Union in its case law referred to the interpretation of the communication to the public and propose additional characteristics which can be useful for analysis of hyperlinks. In the most recent cases CJEU highlighted that in the era of the internet, a comprehensively harmonized EU copyright law is the key issue. There are still many problems with its interpretation. The CJEU undertook to solve this issue and proposed a new approach in the range of communication to the public, and maybe, whole copyright law – application of the new mental element. It is indicated that its use as to the hosting services could put an end to the illegal internet businesses in the range of copyrighted works. However, proposed change raises as many questions as it solves.

The subject matter of this article is to present the new case of U.S. Supreme Court – Star Athletica v. Varsity Brands. In this case court ruled that part of clothes can be protected by copyrights, it is means that the Supreme Court depart from the view presented in the Mazer precedent. In the Mazer precedent court ruled that fashion product cannot be protected by copyrights because they are an useful articles. The article review the statements of parties in the case and court judgment it also presents the consequences to the fashion industry. This article was written during scholarship at the Max Planck Institute for Innovation and Competition in Munich.

The purpose of this article is to present Hugo Grotius’s views concerning the idea of freedom. It must be pointed out that the idea of freedom was not the subject of a separate thought, except for the freedom of the seas, which Grotius dedicated a separate work. Theses on freedom were formulated in the light of other issues such as natural law or the essence and scope of state power. For this purpose, the first part of the article presents a historical background. In the second part, Grotius’s views will be presented in three contexts. First, freedom of the individual as power over oneself. Second, freedom in political terms, as a relationship of community. Finally freedom in the global aspect, as freedom of navigation, trade and migration.

One of the aims of this paper was to characterize liberal theories of rational choice which emerged in XX century, especially theory of public choice. It ought to be noticed that such a task was realized many times by many authors. Due to this fact the text is devoted mostly to review the positions presented by the leading representatives of the intellectual circle mentioned above. Especially the shortages of their philosophical anthropology were pointed out. Moreover, the critique of the linguistic dimension of the rational choice theory was proposed. It was also shown that their endeavours of grounding their works in a long lasting tradition is profoundly disputable.

The present article is devoted to the international cooperation of libraries in the light of treaties on friendship and cooperation concluded by Poland following the 1989 transformations in Central and Eastern Europe. When examining the provisions of the treaties, it could be noted that cooperation of libraries has not been accorded an appropriate position among the fields of common interest of states. Only in a few treaties on friendship and cooperation we can find provisions that directly relate to libraries, and only in one – the Polish-Greek Treaty of 1996, cooperation of libraries is specified. Naturally, this kind of cooperation, on the basis of the analysis made, can be deduced from the provisions of the treaties on scientific and cultural cooperation, nevertheless in the future, it should be given an appropriate position in the treaties on friendship and cooperation concluded by Poland and thus it has to be distinguished among priority areas of common interest of the states.

The article presents a legal framework for entrepreneurs in the context of the programs of the European Space Agency (ESA). ESA has its own procurement and delivery system in which contractors can be entrepreneurs, including micro, small and medium sized ones (SMEs). Within the ESA system, entrepreneurs may be contractors themselves or be partners in consortia or be subcontractors of entrepreneurs (or consortia) that have concluded an order or supply contract for ESA. This article briefly presents ESA’s procurement procedure along with three selected clauses in ESA’s contracts: the provision of intellectual property rights, the “Best Practices” clauses for subcontractors and the special clauses ensuring participation of SMEs in ESA’s programs.

The article analyzes in the three paragraphs the issue of Muslim minorities in China, focusing on the history of Muslims in China, certain groups who live and cultivate their religion on the Chinese territory and the current situation of main two ethnic groups – Hui and Uygur. In the first paragraph article focuses on the history of the phenomenon of Islam’s development in China. Second paragraph focuses on the actual ethnic groups, concerning Hui, Uygur and other, smaller ethnic Muslim groups in China. The third paragraph shows the political situation of Hui and Uygur groups today.

In civil proceedings, experts are appointed representing different scientific areas offering wide-ranging expertise on issues requiring expert opinion. This article aims to describe the role and importance of experts in the informatics area who are appointed in civil proceedings. The contribution of expert opinions in informatics has been defined on the basis of their practical use in judicial proceedings under the rules of civil procedure. The importance of an informatics expert opinion can be seen only through the analysis of case-studies. It is possible to see on the basis of the analysis of selected rulings in which cases the courts considered it necessary to appoint an expert in informatics, and in which situations the court considered it as unjustified. The considerations elaborated upon in this article relate mainly to the type of specific information required from court experts in informatics including the purpose for which the parties requested the appointment of an expert together with the influence of the expert opinion on the content of a court ruling. Despite a limited number of years so far in appointing court experts in informatics, in line with the continued developments in technology, their contribution in civil proceedings has been growing steadily. Judges can use opinions made in this area in many cases which are drawn from a very broad range of legal and factual bases. There are more and more cases which require the involvement of court experts in informatics. The subject matter investigated by a court expert in informatics is constantly evolving and broadening in scope. It may be assumed that over time court experts in informatics will be among the most frequently appointed experts to prepare opinions in court proceedings.
