Zygmunt Wojciechowski (1900–1955) was a historian of law at the University of Poznan. A student of one of the greatest Polish historians – Oswald Balzer – he was a medievalist, heavily involved in politics both in the times of Second Republic and the beginning of the Polish People’s Republic. His works comprised of content of cognitive qualities, but was always strongly coloured with politics. He was the creator of the theory of native Polish lands, located between Odra, Warta and Vistula Rivers. He is looking at history through the prism of Polish-German relations and he critically evaluates the history of the state, which moved away from traditional Polish settlement areas and led a disastrous policy of expansion to the East, which brought its fall and partitions. Wojciechowski welcomed the return of Poland to the western lands (recovered) in 1945, as a compensation of wrongs suffered in the struggle against Germany. The literature on works of Wojciechowski is controversial and requires recognition in a new synthetic book, which is the main thesis of this study

In his article Bogdan Grzelonski, Polish ambassador to Canada between 1997 and 2000, discusses a book edited by author and historian Frank Costigliola Kennan diaries. He states that the masterfully selected and annotated diaries make for a fascinating reading about Kennan’s professional and personal life. He specifically brings to attention these parts, that are concerned with the Soviet Union, Europe and Poland. B. Grzeloński underline that Kennan raised in his diary issues which still ring clearly today.

The article presents an analysis of whether notaries can act as mediators in Lithuania. In particular, can the notaries effectively lead mediation in family and inheritance cases. On the 25th of September, 2015 the Polish Parliament adopted the act amending the 1989 Act on Associations. Though there had been eight subsequent amendments, the 2015 act was the first aiming to substantially adapt the Act on Associations – the first legal effect of the political consensus achieved within the Round Table negotiations of the then Communist government and the “democratic opposition” – to new social and economic conditions of Poland. 26 years of functioning of the Act have been the time of passage from “real socialism” to “democratic state of law” having to base, according to the 1997 Constitution, on “social market economy”, and from a practical isolation of Poland within its borders to its opening to the world, in particular within the framework of European institutions. The article sketches, also on the basis of the author’s personal experience due to his participation in drafting and legislative works, the course of the revision works initiated in 2009, in particular of parliamentary works on the 2014 President’s draft law, as well as their limited results achieved in the 2015 act. Analyses of causes of such limitation are presented on the plane of the most important items of the pre- -parliamentary and parliamentary debates, i.e. right of legal persons to associate on equal terms with physical persons (not included in the President’s proposal), right of foreigners to associate on equal terms with citizens (and inhabitants) of Poland (its application had been proposed by the President, but not included in the act), and legal effect of the, generally agreed, elevation of the status of “ordinary association” on functioning of the present ordinary associations that would not wish to become new ordinary associations; the latter question relates to the fundamental issue of the sense of the freedom of association.

The offense against religious feelings expressed in the text of Art. 196 of PC is strongly embedded in the constitutional liberties and freedoms and human rights of both the Council of Europe and the European Union. Freedom of conscience and religion, which originated in the wording of Art. 196 of PC remains in antinomy to other constitutional values protected by both international acts such as freedom of expression, freedom of artistic expression, the freedom to teach and freedom to enjoy cultural heritage. This requires balancing the content of these freedoms. At present stage there is yet no way to resolve the alleged doctrine of countertype of art.

Freedom of movement within the European Union raises many problems in the area of inheritance law. Until now, the inheriting has been conducted in several EU countries – in the places where there were the fragmented assets of the testator. In an effort to standardize the law of succession, the European Parliament and the EU Council adopted Regulation No. 650/2012 which unified rules of inheritance proceedings in the European Union. The regulation was implemented by Polish legislator with the Act of 20th March 2015 and with the connected regulations. The most important change was the introduction of the inventory list and the change of the succession rule of inheritance debts from the unlimited responsibility to the responsibility limited to the value of the list or inventory.

The Bar, as a professional group dealing with defence and representation, has been developing on Polish lands at least since the beginning of the XVI century. However, only in the second half of the XIX century, so already after Poland was partitioned, the Bar association acquired its first self-government organization. The particularly intensive period of development of the Bar took place during the existence of the Second Polish Republic. The issue of legal basis of its functioning was regulated at the time. The old, unsystematic and post partition legislation was replaced with uniform and more modern law created by the Polish legislator. The rules which constitute the basis of the Bar association system were specified. The rule of equality of the legal profession as well as the rule of freedom and independence of the Bar association were the ones which gained the most importance. Furthermore, the issues connected with performing the legal profession were regulated and specified. Among the aforementioned issues were the following: the essential requirements necessary to perform the profession, the forms in which it is performed, the range of legal activities and the possibility of combining the legal profession with other activities, the rights and duties of a lawyer as well as disciplinary responsibility. Consequently, the interwar period was a short, albeit extremely important stage of the legal corporation’s development.

Legal issues associated with the implementation of digital terrestrial television is not only important because of the assessment of their effectiveness. It also tips about what future regulators, based on the experience that we gain today analyzing the administrative and legal convergence in connection with the introduction of new technologies. Their importance is crucial to the debate on the concept of public interest and related restrictions, as well as to analyze the role of public administration in its protection. An example characterized by a change in the understanding of the public interest in the regulatory area of audiovisual media is primarily the sphere of market control and rationing. In the light of the development of new technologies and enlarging coverage market forces should be emphasized that for the sake of proportionality, the objectives of public interest and private purposes, and the rights and freedoms need a more flexibility with regard to rules governing conventional audiovisual media services without negation proven and still existing standards.

The main aim of the text was to determine the beginning and the end of the nineteenth-century in Russia in the field of socio-political thought. Both the initial turning point and final turning point were chosen with intention to facilitate the understanding of specificity of Russian socio-political thinking in the age of last five tsars. The article presents the position that it’s useful not to adapt the periodizations well known and well-established in contemporary historiography. These are often too universal, good for description of general image of socio-political debate in the industrial era. However, one needs different, more specialized concepts if it comes to grasp the details which make Russian nineteenth-century socio-political mentality unique and developing with its own logic.

The process of consultations with civil society is important as it contributes to a transparent legislative process and a good balance of interests in the legislative proposals. In the European Union works on the consultations with stakeholders have accelerated with the publication of the White Paper on European Governance in 2001. In Poland, we have been observing a number of initiatives concerning public consultations and dialogue with civil society in recent years, both on the side of the central administration and the non-governmental organisations. In this context, the analysis of the European consultation standards is even more important. It seems that the European experience in that area constitutes a good reference for the national solutions. This article analyses the EU standards concerning the process of consultations with interested parties. Having in mind effectiveness of EU lobbying groups as well as certain weak points of the Commission consultation process, this article seeks, in particular, to evaluate the Commission new “Stakeholder Consultation Guidelines”. The article concludes also with some reflections on how the EU standards could apply for the Polish consultation practices in the legislative works.

This article discusses the legal basis and the process of the liquidation of non – public higher education institution when his founder decides to apply for a permission to go into liquidation, granted by the Minister of Science and Higher Education. The oncology package is the common name of set of legal provisions seeking to advance standard care of cancer patient. Due to the fact that cancers are second most frequent cause of deaths in Poland, it was necessary to introduce new regulations which would improve early detection of cancers and ensure fast track therapy. Since the introduction of new provisions in scope of oncology package, in the public system of health care a new category of patients, that is patients waiting for cancer therapy (cancer patients), has emerged. The intention of the legislator was to make diagnosis for patients with suspected malignant tumours more available. Hence, such patients were given an opportunity to be entered onto separate waiting list (list of cancer patients). The key issue was also to set diagnostic and therapy process in order. Thus, a cancer diagnosis and therapy form was introduced and coordinator, who oversees therapy process, was appointed. Other organizational changes in the health care system included in oncology packet cover: determination of maximum period for performance of individual stages of diagnosis and therapy, as well as abolition of limits for funding cancer diagnosis and therapy. The oncology package introduces positive changes, however there are some drawbacks. The most questionable issue is separation of group of oncology patients on the basis of disease type and favouring them, as it may seem, at the expense of other patients.
