Plato and the Universality of Dignity

An important argument in favour of recognising the cultural relativism and against universality of dignity and human rights, is the claim that the concept of dignity is a genuinely modern one. An analysis of a passage from the Demiurge’s speech in Timaeus reveals that Plato devoted time to reflecting on the question of what determines the qualitative difference between certain beings (gods and human being) and the world of things, and what forms the basis for the special treatment of these beings – issues that using the language of today can be described reasonably as dignity. The attributes of this form of dignity seem to overlap with the nature of dignity as we know it today. Moreover, Plato proposes a response both to the question of what dignity is like, as well as the question of what dignity is. It is existential perfection, rooted in a perfect manner of existence, based on a specific internal unity of being. Dignity is therefore primordial in regard to particular features and independent of their acquisition or loss. Plato’s approach allows him to postulate that people be treated as ends in themselves; an approach therefore that prohibits the treatment of people as objects. Both the state and law are ultimately subordinated to the good of the individual, rather than the individual to the good of the state.

The article is to discuss models of accountability for crimes against freedom in selected European countries in the continental system of criminal law. In turn discussed the system of offenses against freedom and then crimes of illegal deprivation of freedom, human trafficking, threat, stalking and impersonation, coercion, taking the image of a naked person, medical treatment without consent and violation of domestic peace in different countries. The whole discussion is an attempt to extract the model solutions.

This article analyzes the penal provisions of the press law when considering the issue of responsibility for the publication of press material. It presents the cases of the notification of the violation of press law, joint and several responsibility of the press, contratyp of press criticism, satire, cartoons and press reports, the limitation of liability of the press, the question of exerting pressure on journalists and on press criticism, press publishing without registration, avoiding the publication of official announcements and arrest warrants, distribute materials of the case, a crime of an admission to the publication, as well as some questions relating to the proceedings for violation of press law.

The article presents, based on the archival materials, the major events that led to the creation of the United Nations War Crimes Commission (UNWCC). The author points out that the development of the international criminal law, which was in its initial stage until 1939, was the work of some outstanding laweyers. The acomplishments of the UNWCC have enabled the establishment of the International Military Tribunal in Nuremberg and Tokyo and carrying out the trials against war criminals.

In his new bestseller, Black Earth, Thimoty Snyder spotlights the covert relationship at the end 1930s between the Polish Government and the Irgun Zvai Leumi, the Jewish underground formation in Palestine affiliated with Vladimir Jabotinsky’s New Zionist Organization. One of the most important figures in that affair was the Irgun representative in Poland, Henryk Strasman, a Warsaw assistant public prosecutor who was later murdered by the NKVD in Kharkov in April 1940, together with other Polish officers in Soviet captivity. Ably aided by his wife, Alicja Strasman (née Friedberg), and in close cooperation with the shadowy Abraham Stern, he sought to acquire arms and ammunition and to secure the training of the Irgun cadres by the Polish army. Strasman was also involved in the establishment of a militant Polish- -language bi-weekly (Jerozolima Wyzwolone) and another paper (Di Tat) in Yiddish to popularize the cause of the insurgency in Palestine among the Jewish public in Poland. In December 1938, Strasman briefed the American ambassador to Poland, A.J. Biddle, on his undertakings. Biddle’s report to Secretary of State Cordell Hull about that meeting adds to our knowledge of clandestine Zionist activity in Poland and illuminates Strasman’s tragic and little-known story.

The continuous development of technology actually does not allow for the creation of a uniform definition of the media, but the redefinition of the notion of media is necessary. The broadcasters – institutions that have played an essential role have lost their importance as a major player in the media market. They take the position of content providers, and the media users (the auditorium, as widely defined today) and they also do not limit their position to the role of the consumers of the content. Through the availability of various materials, the recipients do not have to be limited now to one broadcaster who can affect the perception of the problem or event. This change was caused by the opportunity of the interaction between the broadcaster and the user. The recipient does not feel just a passive listener, but can actively participate in the creation of media content and thereby substantially influence the content transmission. This issue is important in the situation where the media are required for specific actions, eg. in case of threats and emergencies. The question which arises here is what kinds of media should fullfil such obligations and to what extent you can limit the freedoms and fundamental rights of individuals in the area of communication.

The purpose of this article is to show the nature and legal requirements of the will for the benefit of churches or pious works. The conclusion reached in these considerations is that post-classical roman law, although it did not recognize the legal personality of the Catholic Church, guaranteed the particular ecclesial communities and pious works run by the Church wide access to material goods, by way of testamentary universal succession, as well as testamentary succession under particular title. This was made possible through the recognition of ecclesial communities and charities as legal entities having testamenti factio passiva by Roman law. Wills benefiting churches or pious works necessitated, for their validity, abiding by all of the formal requirements for making a declaration of intent, in particular the presence of seven witnesses, regardless of whether the declaration was oral or written. As such, wills benefitting churches or pious works were not considered under Roman law to be privileged in form. It was Pope Alexander III who first challenged the requirement of the presence of seven witnesses. Since then, canon law treated wills for the benefit of churches or pious works as a privileged kind of will, whose validity required the presence of only two witnesses. Thus, this type of will was an institution present in both legal orders, but only received its privileged nature in medieval canon law.

The article is the issue of disciplinary responsibility in a historical perspective. This issue was already developed earlier by Professor Zbigniew Leoński in his book concerning disciplinary responsibility from 1959. The article examines the mechanisms of defamation in the internet space, social media and Facebook in particular. Human dignity is protected both as a constitutional value and as an individual right, though in everyday practice law-enforcement bodies usually tend to be unwilling to react to violations of human dignity, while appropriate legal provisions are often not in place to be implemented. Actions taken by the police in investigating appropriate cases do not always manage to identify perpetrators or bring them to justice. Most internet or cyber crime occurs across international borders and can be committed anonymously. There are certain types of defamatory statements that are considered to harm the reputation of the victim. Libel in the internet involves cyberbullying, online harassment, cyber-stalking, and, most of all, internet trolls. Trolling is any deliberate and intentional attempt to disrupt the credibility of others, often involving petty arguments. People tend to lose control of their emotions when they go online. An explosion of raw and unbridled emotions follows, standards wane, and eventually some internet users lose their touch with reality. Cyber violence and online harassment are punishable crimes and are subject to criminal prosecution: defamation, libel and online threats. Stalking and vulgar language in public places are offences subject to public prosecution and the provisions of the Petty Offences Procedure Code. . Generally, a defamatory statement published to third parties has to be proved and it has to be proved that the publisher knew or should have known that the statement that they made which harmed the reputation was false. The good name or reputation of another can be damaged, or even totally destroyed, in a number of ways. To calumniate another is certainly to ruin a person’s or a company their good name and so to do them an injustice. The number of criminal offences under Article 212 has increased four times over the past ten years.

The role of copyright or related rights collecting societies in legal solutions regarding orphan works. The paper analyses in what way collective management organizations can be useful to solve the problem of so-called orphan works. The issue of orphan works (works whose authors or other rightholders are not known or cannot be located or contacted to obtain copyright permissions) is today one of the most important elements of the debate on the future of copyright law. As the number of orphan works keeps growing it becomes a serious problem which requires to be resolved by creating an appropriate legal framework. It seems that the best way of addressing the problem would be to entrust the management of orphan works with specialized entities i. e. copyright or related rights collecting societies. Namely it is worth to consider the extended collective licensing system that proved to be effective in the Nordic countries. However, the Directive 2012/28/EU on certain permitted uses of orphan works which sets out common rules on the use of orphan works is not based of that system. The absence of mutual recognition implies that an extended collective license is valid only in the national territory in which the statutory presumption applies. It would seem that at least diligent search should be entrusted to copyright or related rights collecting societies. They have access to databases on the works, objects of related rights and rightholders and they interact with similar organizations in other Member States. In the Polish copyright law provisions referring to the collective management of copyright do not fulfill its function. Professional, strong, effective and representative copyright collecting societies with well-defined area of activity are needed to solve the problem of orphan works. This requires amendment to the Copyright Law.
