Special character of cultural rights and its position in Polish Constitution – the attempt of characteristic and classification

The present paper is an analysis of the legal regulations on cultural rights in Polish Constitutional Legal system. The author claims that culture, as a unique value, has a special impact on personal development of every human being. As a consequence also cultural rights have a special importance for modern society and nation. Paper presents different meanings of culture, gives the definition of cultural rights and critically analyses constitutional provisions of article 5,6 and 73. Author also sug- gests the need for amendment of Chapter II of Polish Constitution which aim is to add provision guaranteeing the right to access to culture. The content of the article is a sum- mary of author’s Phd paper.

In the conditions of modern state social and cultural policy of Belarus, the problem of studying and using the cultural heritage is very actual: the creation of projects and programmes of social and cultural development demands the research of history, heritage and traditions. A noticeable trace in the Belarusian cultural heritage was leftby the Old Believers who moved on Belarusian lands in the second half of the 17th century. The history of the Old Believers on the Belarusian lands before the beginning of the 20th century is widely represented in the monographs of A.A. Gorbatsky: The Old Believers in Belarus at the End of the 17th - the Beginning of the 20th Centuries, Brest 1999; The Old Belief in the Belorussian Lands, Brest 2004. There is no monographic literature concerning the history of the Old Belief in Belarus in the 20th century. In the Belarusian scientific magazines there are some articles by T. Dobzhinskaya and T. Hursan devoted to the analysis of the life and activity of Old Believers in Belarus in the 20th century. The articles by T. Dobzhinskaya deal with the history of the Old Belief in Vitebsk region in the first half of the 20th century. T. Hursan in her articles analyzes ethnographic features of Old Believers in Mogilev region. The aim of this article is to show some peculiarities of the development of the state policy in relation to Old Believers in Belarus in the 20th and the beginning of the 21st centuries.

The purpose of this article is to present and analyze the foundations and premises of Nazi cultural policy, and the bodies responsible for its implementation, the two most important ones being: National Socialist Society for German Culture and the Ministry of National Enlightenment and Propaganda of the Reich. Policy in this case is interpreted as intentional activity of the authorities in the field of culture, aimed at influencing the attitudes and identity of the population of the Third Reich. The analysis covers the most important documents, statements and declarations of politicians and their actual activity in this domain. Adopting such a broad perspective allowed to comprehensively show both the language and the specific features of the messages communicated by the Nazi authorities, and its impact on cultural practices.
