Artificial intelligence, besides blockchain, is the main topic discussed by representatives of nearly every branch of economy. Some entities are trying to search for their place in the world of artificial intelligence driven technology and others are looking carefully at the developments in the AI. Undoubtedly, software making use of the artificial intelligence can be viewed as something that can change the world we live in. The titles of press releases or other information sources are stimulating ones imagination in the range of possible application of artificial intelligence. At the same time, there is a group of people from the technology sector, that are concerned by the rapid and limitless development in this regard. The future of artificial intelligence and its application is still unknown but there are as many positive expectations as negative predictions. There are still many questions that have to be answered before the time that deep or strong AI will be prepared for everyday use. One of such questions is whether copyright is only dedicated for human beings? If the answer is affirmative than the next question that have to be asked is what form or type of protection can be used for works of art made not by humans? This are not the only problems that may arise (or has already arisen) from the use of AI.

Undoubtedly linking is one of the technologies that constitute a basis of the web. Links are most commonly used for indication of the place of content in the richness of the internet. However, they can also be used for illegal actions concerning communication of works protected under copyright. Legality of linking depends on the classification whether they are communicating such work to the public in the meaning of art. 3 (1) of Directive 2001/29/WE. Court of Justice of European Union in its case law referred to the interpretation of the communication to the public and propose additional characteristics which can be useful for analysis of hyperlinks. In the most recent cases CJEU highlighted that in the era of the internet, a comprehensively harmonized EU copyright law is the key issue. There are still many problems with its interpretation. The CJEU undertook to solve this issue and proposed a new approach in the range of communication to the public, and maybe, whole copyright law – application of the new mental element. It is indicated that its use as to the hosting services could put an end to the illegal internet businesses in the range of copyrighted works. However, proposed change raises as many questions as it solves.

Problematyka tytułu prasowego, a zwłaszcza jego ochrony budzi spore wątpliwości natury teoretycznej, ale także praktycznej. Po pierwsze już chociażby z tego tytułu, że pojęcie tytułu prasowego nie zostało zdefiniowane w ustawie z dnia 26 stycznia 1984 r. Prawo prasowe54, ani w żadnym innym akcie normatywnym. Po wtóre, problematyka ochrony prawnej tytułu prawnego może być rozpatrywana z różnych perspektyw. Może to rodzić wątpliwości co do różnych źródeł udzielanej ochrony prawnej, a tym samym konieczności spełnienia innych przesłanek takiej ochrony przewidzianych przez odrębne regulacje. Należy jednak podkreślić, iż z samego faktu rejestracji dziennika lub czasopisma nie przysługuje żadne prawo podmiotowe. Jest to jedynie uprawnienie o charakterze formalnym. Nie oznacza to jednak, że tytuł prasowy nie może być przedmiotem obrotu cywilnoprawnego. W praktyce tytuł najczęściej będzie przysługiwał wydawcy, ale nie jest to regułą. Tytuł prasowy może być chroniony skutecznie na innych podstawach np. jako utwór w oparciu o przepisy prawa autorskiego, bądź na płaszczyźnie przepisów prawa cywilnego zapewniających ochronę dóbr osobistych, ewentualnie jako znak towarowy, wreszcie przepisami o zwalczaniu nieuczciwej konkurencji.

This article discusses the organisations for collective management of copyrights in the polish legal system. The subject of this article is a critical evaluation of application of competition law to the undertakings active on the copyright market. The study focuses on the conduct of the collecting organizations of copyright. Its aim is to present new aspects and methods that need to be considered in analyzing the market position of national collecting organizations. The clarification of the main problem is preceded by examination of the notion of dominant position as defined in Polish antimonopoly law. Next, the article address the implications of cross-border online copyright trade on the evaluation of the market position of national collecting societies. Further considerations argue for an integrative approach that give attention to the dynamic factors of competition and highlights public interest issues.. In this regard the claim is that the development of competition on the copyright market has to sustain the objectives of intellectual property regulations. The author point out that ratio legis of copyright law is anchored in the Constitution, that determine the need for balancing the individual and public interest in respect to the creative activity.

The exhibition as a matter of copyright. The exhibition is a complicated subject to copyright. It consists of exhibits – tracks – objects of copyright and other items. The exhibition is a collective work, if adopted in its system works, the choice of topics, descriptions, graphics and other elements of the company are original. The creator is the curator of the exhibition. Curator can be creative or auxiliary. Copyright entitled curator creative. If he is employed under a contract of employment and create an exhibition as an employee – is purely personal copyright. Copyright property is entitled to his employer. For the employer, it must be right to the title of the exhibition.

State system of intellectual property rights protection in Ukraine and Poland

The article’s theme is relevant, as intellectual property has become one of the most popular issues discussed in the modern business world. Intellectual property is a product of the human mind, resulting from creativity protected by the law. Protecting intellectual property rights is increasingly crucial in economic development and trade growth. Many goods containing intellectual property objects are moving across the Customs Union border, and their share makes up a significant part of the value of goods. According to some estimates, up to 80% of global trade comprises intellectual property goods. At the present stage, there is a tendency for the results of intellectual activity to acquire an increasing commodity dimension. Moreover, increasingly, objects of intellectual property – products of intellectual labour are created for successful market functioning. For intellectual property to become a full-fledged object of agreements, it is necessary to provide it with a reliable legal framework, create convenient legislative support for it, and, at the same time, organize economic protection. The article presents the main aspects of state protection of intellectual property rights from alleged infringers in Poland, examines various types of protection of intellectual property rights in Poland, and singles out state bodies and other entities protecting intellectual property rights in Ukraine.

In this paper an attempt is made to determine the material, subjective and temporal scope of application of an electoral exception provided for under Art. 31 (3) of the Copyright Law. To this end, normative acts, judicial decisions, and doctrinal views were examined. Also, the author analyses the concept of “election event” and the relevance copyright law has to it. In conclusions, a postulate de lege ferenda is formulated.
