It is not surprising that subsidiarity is very often discussed with autonomy and federation (equally multidimensional concepts, similarly discussed in science). It is clearly evident taking into account, for example, results of analysis of the key words (tags) in scientific publications. The European Union has significantly contributed in popularizing of the concept so it is no surprise that strongly linked with EU's problems has become a central point of the discussion of its organizational structure and internal relationships between forming elements. It is difficult to imagine analysis of the conditions for implementing of subsidiarity in Germany without prior presentation of the state political system's solutions. Studying the structure and functioning of public administration enables to identify the place and role of the local government, to measure degree of independence of the local authority as a central point of discussion in relation to the subsidiarity.

On the Conditions for Implementing the Constitutional Principle of Subsidiarity in the Horizontal Aspect

The article addresses the issue of the conditions for implementing the subsidiarity principle in the horizontal aspect. The problem of required attitudes and actions on the part of public entities and citizens, based on a belief that authority does not by its very nature have absolute competence in matters concerning the definition and implementation of the public interest, is discussed against the background of the constitutional principle of subsidiarity. Actors of the citizens sector, having the will to be autonomous and to propose initiatives, are able to pursue the general interest well, which, however, requires meeting certain conditions. This paper emphasizes the issue of division of tasks between the public and civil sectors, which is to enable individuals and non-governmental structures created by them to participate in public decision-making. This issue constitutes the main research problem.
