Referenda konstytucyjne w Irlandii z marca 2024 r. Czy Irlandia zrobiła krok wstecz?

Ireland’s March 2024 Constitutional Referendums. Has Ireland Taken a Step Back?

In Ireland, the institution of referendum is an important means of shaping the country’s political reality. As a result, the sovereign expresses his opinion on the most important issues, including changes to the constitution. Since the act was passed in 1937, citizens have voted on 40 amendments, 11 of which have been rejected. The last time this happened was on March 8, 2024. The 39 Amendment to the Constitution proposed to change the content of art. 41 so that it takes into account a broader concept of family. The purpose of amending Amendment No. 40 was expanding the concept of family care. The analysis presented in the text aims to present the circumstances that led to the rejection of the government’s proposal to change the constitution in the referendum. The research used primarily the legal and dogmatic method, as well as the decision-making and behavioral methods.

W Irlandii instytucja referendum jest istotnym środkiem kształtującym rzeczywistość polityczną kraju. W jego wyniku suweren wypowiada się w najistotniejszych kwestiach, w tym także zmiany konstytucji. Od czasu uchwalenia tego aktu w 1937 r. obywatele głosowali nad 40 poprawkami, z których 11 zostało odrzuconych. Ostatni raz miało to miejsce 8 marca 2024 r. W 39 poprawce do Konstytucji zaproponowano zmianę treści art. 41 ustawy zasadniczej tak, by uwzględniał on w swej treści szerszą koncepcję rodziny, opartą nie tylko na małżeństwie, ale także na „innych trwałych związkach”. Celem nowelizacji poprawki nr 40 było zastąpienie artykułu 41.2 Konstytucji uznającym opiekę rodzinną zamiast podkreślenia roli kobiety w domu. Przedstawiona w tekście analiza ma na celu przybliżenie okoliczności, jakie doprowadziły do odrzucenia w referendum rządowej propozycji zmiany konstytucji, co pozwoli zdiagnozować, czy wygrali zwolennicy ugrupowań konserwatywnych, czy zawiodła kampania referendalna. W badaniach zastosowano przede wszystkim metodę prawno-dogmatyczną, a także metodą decyzyjną oraz behawioralną.
