Hydrological Poverty and Access to Water as Challenges to Human Rights Protection in the European Blue Deal

In the legal sciences, the issue of water availability as a new human right has been gaining at importance in recent years. In the European Union, work is currently underway to enact the equivalent of the European Green Deal – i.e. the European Blue Deal, which will be dedicated exclusively to water issues. The purpose of this article is to analyze how the emerging comprehensive EU water strategy takes into account the legal and human dimensions of problems related to access to water and water poverty, and whether it provides for effective instruments to protect the right to water in the European Union. The work previously attempted to systematize the concepts of water security, then pointed to the most important legal acts constituting the so-called right to water and defining its elements. Subsequently, selected provisions of the EBD exposing the legal-human dimension of access to water, were presented.

Ubóstwo hydrologiczne i dostęp do wody jako wyzwania dla ochrony praw człowieka w Europejskim Niebieskim Ładzie

Na gruncie nauk prawnych zagadnienie dostępności wody jako nowego prawa człowieka zyskuje w ostatnich latach na znaczeniu. W Unii Europejskiej toczą się obecnie prace nad uchwaleniem odpowiednika Europejskiego Zielonego Ładu – tj. Europejskiego Niebieskiego Ładu, który będzie dedykowany wyłącznie kwestiom związanym z wodą. Celem niniejszego artykułu jest analiza, w jaki sposób tworząca się kompleksowa unijna strategia wodna uwzględnia prawno-człowieczy wymiar problemów związanych z dostępem do wody i ubóstwem wodnym, a także, czy przewiduje skuteczne instrumenty służące ochronie prawa do wody w Unii Europejskiej. W ramach prac podjęto uprzednio próbę usystematyzowania pojęć związanych z bezpieczeństwem wodnym, następnie wskazano na najważniejsze akty prawne konstytuujące tzw. prawo do wody oraz definiujące jego elementy. Następnie przedstawiono wybrane postanowień ENŁ, eksponujące prawno-człowieczy wymiar dostępu do wody.
