Dispute about Existence of Natural Legal Oder

The author analyses genesis and development of natural law and its contemporary meaning He rise a question why Constitution of the Republic of Poland of 2 April 1997 do not expose a highest position of natural law in country’s legal order. Constitution in several places, including preamble, is based on natural law axiology. The National Assembly, which passed a Constitution had a problem with definition of “natural legal order”. As long as such a clause has not precise legal meaning, it would be difficult to situate such a norm in the Constitution which is directly applied (art. 8.2 of Constitution). A hesitancy to introduce highest position of natural law was additionally connected with the centerleft characteristic of the National Assembly elected in 1993. Once attitudes of Polish people has changed toward center-right orientation, that may influence a new look on the question of situating a natural law in the Constitution when pressure to its change will occur.

Przedmiotem badań podejmowanym w tekście jest jedna z głównych podstaw teoretycznych libertarianizmu: zasada autowłasności. Problemem badawczym artykułu jest pytanie: Czy zasada autowłasności jest aksjomatem? Metodą badawczą zastosowaną w artykule jest metoda disputatio. Na podstawie przeprowadzonych badań w tekście proponowana jest teza afirmatywna: zasada autowłasności ma status logiczny aksjomatu. Artykuł prezentuje wypracowaną siatkę pojęciową rozróżniającą samoposiadanie, auto własność i uzasadnienie autowłasności oraz rozwija linię argumentacyjną wskazującą, że choć prima facie to samoposiadanie, a nie autowłasność jest aksjomatem, to ponieważ samoposiadanie z konieczności implikuje autowłasność, to także autowłasność musi mieć status logiczny aksjomatu.

References to Natural Law in the Constitutions of Modern States

The article is a comparative study of constitutional references to natural law, with a particular emphasis on the Constitution of the Republic of Poland. The findings presented in the study are both of qualitative and quantitative nature. References to natural law, recognized in the constitutions of 48 countries in the world, relate almost exclusively to fundamental human rights and freedoms. Usually, the constitution-maker assigns the title “natural” or “inherent” to all fundamental rights of person or to some of them. In none of the Basic Laws, natural law has been included into formal sources of law, nor its hierarchical relation to positive law shown. No constitution specifies a definite concept of natural law. The authors of the constitutions, speaking generally about natural rights, have not wanted to engage in philosophical and legal disputes accompanying the category of ius naturale.

The development of the “natural law” movement during the Enlightenment era has influenced European legal thought and provoked discussions on the law interpretation method. In the 19th century, French and German legal scholarship developed different methodological approaches referring to some historical, social, and multidimensional aspects and foundations of law. The article explores the evolution of the main scientific positions on the method of interpretation of the law which have appeared in French jurisprudence in the 19th and the first half of the 20th century. In France, from the early 19th century, the positivist school of exegesis dominated legal studies. In the half of the century, a new trend of scientific research was developed. The representatives of the current have pondered pluralism of the methods applied in legal research. Then, in France, we observe the rise of the “free scientific research” initiated by François Gény.

The purpose of this article is to present Hugo Grotius’s views concerning the idea of freedom. It must be pointed out that the idea of freedom was not the subject of a separate thought, except for the freedom of the seas, which Grotius dedicated a separate work. Theses on freedom were formulated in the light of other issues such as natural law or the essence and scope of state power. For this purpose, the first part of the article presents a historical background. In the second part, Grotius’s views will be presented in three contexts. First, freedom of the individual as power over oneself. Second, freedom in political terms, as a relationship of community. Finally freedom in the global aspect, as freedom of navigation, trade and migration.

From Natural Rights to the Dignity of the Human Person. Considerations on the Axiology of the Constitution of the Republic of Poland

The article is a reflection on the issues of natural law. The dominant view in the literature on the subject is that natural law is a kind of matrix that should be duplicated by the legislator in order to prevent legal injustice. According to the Latin paremia: Lex iniusta non est lex (Unjust law is not law), the legislator must take into account unspecified higher- level norms. The aim of the article is to look from a philosophical perspective at the axiological foundations of the Polish legal order in the context, primarily, of the sources of law. According to the author of the article, in modern times the rationalism of natural law is becoming apparent, and its religious foundations will not necessarily be acceptable in a culturally pluralized society. The legal analysis method was used, the historical-legal method (in terms of examining the evolution of legal ideas underlying individual constitutional regulations) and the hermeneutic method in relation to the examination of the Constitution as a product of culture, not so much in the linguistic, but in the social, cultural and historical layer. The analysis of applicable legal provisions also forced the use of the formal and dogmatic method.
