The objective of this paper was to analyze the socio-cultural and personal reasons pivotal to the openness of the conflicting parties to a dialogue in the framework of family mediation. In the quest to answer the question what factors can influence the development of the family mediation in Poland and its acceptance both by the society and the families in conflict, the author presented the results of international and Polish research on the efficacy of the family mediation process and the readiness of the parties to use the mediation in family conflicts. Two theoretical concepts characterizing the socio-cultural origins of resistance to mediation were analyzed in detail, namely that of the social resistance proposed by B. Mayer and that of the moral resistance by R. Benjamin. Moreover, the paper addressed the issue of the promotion of mediation together with the unrealistic expectations as to what can be achieved through mediation, mythologization of mediation and dilemma connected with the neutrality of the mediator. Finally, an integrated systemic approach to family mediation was proposed, which could enhance the chances of acceptance of the mediation by the parties in conflict. In essence it is proposed that the promotion of mediation should be exercised on three levels: (1) general societal level (to promote the winwin solutions in family conflicts), (2) level of specific educational activities for the conflicted parties (e.g. organization of pre-mediation consultative meetings), and (3) level of specific actions targeted at various professional groups (e.g. judges, lawyers, probation officer, employees of the family support centres, etc).

Re-Education in Penal Institutions and Types of Resistance towards Prison Isolation

This article concerns the inmates’ resistance against prison isolation and against the process of rehabilitation change. This article aims to present the results of questionnaire research aimed at establishing the correlation between the type of resistance elected by the prisoners and their prison system (and the choice of specific rehabilitation programs). The resistance is understood as an expression of rebellion against the rejection and may be manifested in the form of aggression, hostility or internal dissension. This article concerns four styles of resistance: transformative, accommodative, passive and aggressive which are differentiated by the power of involvement in resistance and prisoners’ behavior towards penal institution. Resistance to isolation in prison is thus recorded a response to the situation of imprisonment, which is perceived by prisoners as imposed by the unjust restriction. It is bound by the prisoners do not accept coercion and lack of leeway and a sense that the prison staff is trying to dominate them. The research was conducted using the method of test questionnaires were 413 prisoners, prison inmates in two prisons closed type. The study, presented as a ratio analysis can be a starting point for further and extended to the whole country research on the motivation of prisoners to participate in rehabilitation programs implemented by the prison service in Poland.

Hercules is Disobedient! The Essence of Judicial Resistance through the Eyes of Ronald Dworkin

In global jurisprudence and legal theory, we are currently observing a renaissance of interest in the thought of Ronald Dworkin, an outstanding legal philosopher, lawyer and humanist with an incredible sense of justice. There is still debate over the practical application of integral legal philosophy. Dworkin’s philosophy marks the “third way” in the dispute between legal positivism and the natural law approach. Using Dworkin’s concept of law, an attempt can be made to answer the question to what extent can the conscience of a person holding the office of a judge influence the process of making/applying law? The desire to look for positive patterns of creating and reforming law pushes us to analyze recent changes through the prism of Dworkin’s philosophy. The previous years have revealed to us a universal value and feature of our legal system a judge who interprets the law becomes the central figure of legal culture.

Resistance as a manifestation of subjective orientation. Considerations on the margins of social work

This paper attempts to analyse the concept of resistance in social work. The category of resistance is characterized by a multiplicity of meanings, which means that it is understood in many ways, depending on civilizational and cultural contexts. Reflections on the concept of resistance in the humanities and social sciences are neither simple nor straightforward, as each discipline has its own view of this category. The analyses carried out in this study are interdisciplinary, but the point of reference is social pedagogy and social work developed by it. The aim of the article is to present the achievements of the category of resistance, taking into account three ways of interpreting it: as an individual reaction of the person receiving the help, as a reaction of the person receiving the support to the relationship with the professional, as a reaction of the participants of the social welfare system to local practices, institutional and governmental policies. In the discourse of social work, it is more common to see resistance as an individual reaction and a reaction to contact with a professional, and less so as a manifestation of subjective orientation, which is a resource to reach for in the face of oppressive practices. Therefore, the article devotes special attention to this issue. The whole analysis is complemented by a reflection on the challenges faced by social work education, through which the aim is to activate the resistance competences not only of the people supported, but also of the professionals themselves. The content analysis was based on a review of Polish and foreign literature presenting the issue of resistance in relation to social work.
